01Who you're contracting with
Vivacorder is operated by Mohamed Ghoweba, a sole proprietor (the "Seller", "we", "us"). By creating an account, using the service, or paying for a subscription, you ("you", "the user") agree to these Terms.
02The service
Vivacorder is a browser-based platform for recording narrated teaching videos. You pair visual content (PDFs, images, video, HTML, or a blank canvas) with structured lesson cards and narrate over them; the final video is exported locally as an MP4 (or WebM on older browsers).
The service runs entirely in your browser. The Free tier permits recordings up to 5 minutes with a small watermark. The Pro tier removes the length limit and the watermark.
03Acceptable use
You agree not to:
- Use the service for any unlawful purpose, fraud, or spam;
- Upload, record, or distribute content that infringes intellectual property, privacy, or other rights;
- Interfere with security (malware, network probing, scraping, reverse engineering);
- Resell, sublicense, or redistribute the service without our written consent;
- Circumvent technical limits (recording length, watermark).
You are responsible for the lawfulness of any content you record, store, or share through the service, and for having the rights to any third-party material you include.
04Account & credentials
You must provide accurate registration information and keep your login credentials confidential. You are responsible for all activity under your account. If you are using the service on behalf of an organization, you confirm you have authority to bind that organization. Individuals must be of legal age in their jurisdiction.
05Intellectual property
The Vivacorder software, branding, documentation, and underlying technology are owned by the Seller. We grant you a limited, non-exclusive, non-transferable, non-sublicensable right to use the service within the plan you've selected. You retain ownership of your own content — your projects, recordings, and narration.
06Payment, billing & cancellation
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, currencies, tax, invoicing, billing frequency, subscription renewals, and cancellations are governed by Paddle's Buyer Terms. Subscriptions auto-renew until cancelled. You can cancel any time and will retain Pro access until the end of the current paid period.

08Service level & warranties
The service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free, or available at any particular time. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
09Liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.
10Your indemnity
You agree to indemnify and hold us harmless from any claims arising out of (a) content you record, upload, or share through the service, (b) your unlawful use of the service, or (c) your breach of these Terms.
11Suspension & termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may stop using the service at any time. On termination, your right to use the service ends; you can export your local project files at any time before termination.
12Generative-AI features
If we offer AI-assisted features (current or future), outputs may be inaccurate and are not a substitute for professional advice (medical, legal, financial). You are responsible for your prompts, for verifying outputs, for having rights to any input content, and for how you use the outputs. We may filter, restrict, or refuse outputs that violate these Terms. Repeated IP-infringement reports will result in suspension.
13Changes
We may update these Terms from time to time. Material changes will be notified by email or in-app notice. Continued use after the effective date constitutes acceptance.
14Governing law
These Terms are governed by the laws of the Seller's jurisdiction of residence, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer-protection law in your country of residence provides otherwise.
15Force majeure
Neither party is liable for failure to perform due to events beyond reasonable control (natural disasters, war, outages of third-party infrastructure, government action).
